Toronto Condo Team is a real estate team and marketing brand associated with Franco Dinatale, Sales Representative, Right At Home Realty, Brokerage.

Toronto Condo Team is not a separate or independently registered real estate brokerage.

All regulated real estate trading services advertised, offered or provided by Franco Dinatale through Toronto Condo Team are provided on behalf of and through:

The name Toronto Condo Team is used to market and identify real estate services provided by Franco Dinatale and any appropriately registered real estate professionals who may work with or be presented as part of the team.

Toronto Condo Team does not operate independently of Right At Home Realty, Brokerage for the purpose of trading in real estate.

Any salesperson, broker or other registered real estate professional presented on TorontoCondoTeam.ca remains registered with and trades through their applicable employing brokerage. Where a member of Toronto Condo Team is employed by Right At Home Realty, Brokerage, that registrant's regulated real estate services are provided on behalf of Right At Home Realty, Brokerage.

3. Regulatory Framework

Real estate services provided through Toronto Condo Team are subject to applicable Ontario real estate laws and regulations, including the Trust in Real Estate Services Act, 2002 ("TRESA"), its regulations and applicable requirements administered by the Real Estate Council of Ontario ("RECO").

Real estate activities may also be subject to:

• Right At Home Realty, Brokerage policies and supervision
• MLS® rules and data agreements
• Applicable Toronto Regional Real Estate Board requirements
• Canadian Real Estate Association requirements where applicable
• Other applicable federal and provincial laws

Nothing on TorontoCondoTeam.ca is intended to modify, reduce or replace any legal, regulatory or professional obligation applying to Franco Dinatale or Right At Home Realty, Brokerage.

4. Role of Right At Home Realty, Brokerage

Right At Home Realty, Brokerage is the employing brokerage through which Franco Dinatale provides regulated real estate services.

The Brokerage is responsible for brokerage-level supervision and administration of real estate trading activities in accordance with applicable law and brokerage policies.

Real estate representation agreements, listing agreements, buyer representation agreements and other regulated real estate agreements are entered into through the Brokerage as required by applicable law.

Toronto Condo Team is not a substitute for, and does not replace, the legal identity or responsibilities of Right At Home Realty, Brokerage.

5. Role of Franco Dinatale

Franco Dinatale is registered as a Sales Representative with Right At Home Realty, Brokerage.

References on this Website to Franco, Franco Dinatale, Toronto Condo Team, "our agent," "our team," "we," or similar terminology should be understood within the context that regulated real estate services are provided through Right At Home Realty, Brokerage.

The Toronto Condo Team brand does not independently enter into brokerage representation agreements or trade in real estate apart from the Brokerage.

6. Website Use Does Not Automatically Create Representation

Viewing TorontoCondoTeam.ca, searching listings, using a calculator, subscribing to property alerts, requesting a home evaluation, downloading a guide, submitting a contact form or communicating with Toronto Condo Team does not by itself establish a client representation relationship.

A formal representation relationship is established in accordance with TRESA and applicable brokerage requirements, including the appropriate representation agreement.

Before entering into a representation relationship, consumers may be provided with regulatory information and disclosure documents required under Ontario law.

7. Prospective Clients

A person who contacts Toronto Condo Team to discuss potentially buying, selling, leasing or investing in real estate may initially be a prospective client.

General discussions or preliminary information do not necessarily mean a formal representation relationship has been established.

Before providing regulated services requiring representation, the applicable relationship, responsibilities and representation terms will be addressed in accordance with Ontario law and Right At Home Realty, Brokerage requirements.

8. Clients and Representation Agreements

When a consumer becomes a client, the applicable representation agreement will identify the brokerage, the scope of services, the nature of the representation, remuneration arrangements and other legally required terms.

The rights and obligations arising from a signed representation agreement take precedence over general information contained on TorontoCondoTeam.ca where applicable.

Consumers should carefully review representation agreements and ask questions before signing.

9. Self-Represented Parties

A person involved in a real estate transaction who is not represented by a brokerage may be considered a self-represented party under Ontario real estate legislation.

A self-represented party is not a client of Franco Dinatale, Toronto Condo Team or Right At Home Realty, Brokerage unless a representation agreement is subsequently established.

Where legally required, an appropriate RECO Information and Disclosure to Self-Represented Party form will be provided and explained before assistance is provided to a self-represented party in a transaction.

A real estate professional representing another party cannot provide a self-represented party with the same advice, opinions, advocacy or services that would be provided to that professional's own client.

10. Consumers Already Represented by Another Brokerage

Toronto Condo Team respects existing real estate representation relationships.

Website content and advertising are not intended to solicit buyers, sellers, landlords or tenants who are already subject to an exclusive representation agreement with another registered real estate brokerage.

If you are currently represented by another brokerage, you should review your existing agreement and communicate with your representative before entering into another representation agreement for the same services.

Where required by applicable Ontario rules, communications with a person known to be represented by another real estate professional will be handled in accordance with the applicable regulatory requirements.

11. Listings Offered by Other Brokerages

TorontoCondoTeam.ca may display property listings offered by brokerages other than Right At Home Realty, Brokerage.

Displaying a listing does not mean:

• Franco Dinatale is the listing representative
• Right At Home Realty, Brokerage is the listing brokerage
• Toronto Condo Team represents the seller
• Toronto Condo Team has an agency or representation relationship with the property owner

The applicable listing brokerage will be identified where required by MLS®, TRREB or other data-display requirements. A Toronto Condo Team representative may represent a prospective buyer in relation to a property listed by another brokerage where an appropriate representation relationship exists.

12. Multiple Representation

Certain transactions may involve circumstances in which the same brokerage represents more than one client whose interests are involved in the same trade.

Multiple representation is subject to specific Ontario disclosure and consent requirements.

Where a multiple representation situation arises, the circumstances, limitations and required disclosures will be addressed before proceeding as required by applicable law. Nothing contained on TorontoCondoTeam.ca constitutes advance consent to multiple representation.

13. Designated and Brokerage Representation

Ontario real estate legislation permits different forms of representation depending on the brokerage's policies and the circumstances of the transaction.

Where applicable, consumers will be advised whether they are entering into:

• Brokerage representation
• Designated representation

The applicable representation agreement and required disclosures will determine the specific obligations owed to the client. Website references to "our clients" or "our representation" should not be interpreted as changing the legal form of representation established by the applicable agreement.

14. Remuneration and Commission

Real estate commissions and remuneration are negotiable and are not fixed by RECO, TRREB, CREA or a government authority.

Any commission, fee, rebate, incentive or remuneration arrangement applicable to a specific client will be established through the appropriate written agreement and subject to applicable brokerage policies and regulatory requirements.

General commission information, examples or calculators appearing on TorontoCondoTeam.ca do not create a binding commission agreement.

15. Promotions, Incentives and Complimentary Services

Toronto Condo Team may from time to time advertise incentives, complimentary services, promotions, staging services, painting services, marketing packages or other benefits.

Such offers may be subject to separate eligibility requirements, conditions, limitations and written terms.

Where an incentive or promotion is offered personally by Franco Dinatale rather than generally by Right At Home Realty, Brokerage, this distinction will be disclosed where required. Promotions should not be interpreted as obligations of Right At Home Realty, Brokerage unless expressly identified as such.

16. Property Evaluations and Market Opinions

Any property valuation, market estimate, home evaluation or condominium evaluation offered through Toronto Condo Team is provided as a real estate market opinion or preliminary estimate unless expressly stated otherwise.

Such evaluations are not formal certified appraisals and do not guarantee a particular sale price or market result.

More detailed valuation services may require additional property information, comparable market analysis and professional review.

17. Independent Professional Advice

Real estate representatives are not substitutes for other regulated professionals.

Consumers should obtain appropriate independent advice concerning matters such as:

• Legal issues
• Engineering
• Taxation
• Zoning
• Accounting
• Environmental matters
• Mortgage financing
• Condominium status certificates
• Property inspection
• Other specialized professional matters

A recommendation or referral to a third-party professional does not make that provider part of Toronto Condo Team or Right At Home Realty, Brokerage unless expressly stated.

18. Third-Party Professionals and Services

Toronto Condo Team may provide introductions or links to mortgage professionals, lawyers, inspectors, contractors, designers, stagers, movers or other service providers.

Unless expressly disclosed otherwise, these providers operate independently. Consumers remain responsible for evaluating and selecting any third-party provider.

Where a referral or other arrangement creates a disclosure obligation under applicable law, the appropriate disclosure will be made.

19. Accuracy of Brokerage Information

Toronto Condo Team intends to keep its brokerage and registrant information current.

If Franco Dinatale's registration status, employing brokerage, office location or other material regulatory information changes, Website information and advertising will be updated as appropriate.

Consumers may independently verify the registration status of Ontario real estate agents and brokerages using RECO's public registrant-search resources.

20. No Independent Brokerage Representation by Toronto Condo Team

For clarity: Toronto Condo Team is not itself a real estate brokerage.

The Toronto Condo Team name must not be interpreted as suggesting that it is separately registered, licensed or authorized to trade in real estate independently of Right At Home Realty, Brokerage.

Any regulated real estate service promoted under the Toronto Condo Team brand by Franco Dinatale is provided through Right At Home Realty, Brokerage.

21. Brokerage Policies

Real estate services offered through Toronto Condo Team remain subject to lawful policies and procedures established by Right At Home Realty, Brokerage.

Where a Website statement, promotion, process or marketing statement conflicts with an applicable brokerage requirement or mandatory legal requirement, the applicable brokerage, legal or regulatory requirement will govern.

22. RECO Information Guide

Before providing real estate services or assistance where required by Ontario legislation, consumers will be provided with applicable information and disclosures prescribed by RECO.
